愛知県警は23日、名古屋市北区のコンビニ大手セブンイレブン加盟店で、アルバイトが急に欠勤すると罰金を支払わせる契約を結んだとして、中国籍の夫婦で経営者の男（37）と店長の女（37）＝いずれも同市中村区＝を労働基準法（賠償予定の禁止）違反の疑いで書類送検した。
労基法は、働けないことを理由とする違約金や損害賠償を支払わせる契約を禁止している。北署によると、２人は「急にバイトが休むと、自分たちが穴埋めをしなければいけない。自由な時間が欲しかった」と供述し、容疑を認めている。
送検容疑は昨年９～12月、10～30代のバイト男女５人に「急に欠勤した場合は１回１万円の罰金を徴収する」との契約を結ばせた疑い。

今日のニュースは、「急に欠勤した場合は１回１万円の罰金を徴収する」との契約を結ばせたことが悪質と見られたのか、書類送検にまで至っています。なお、このような行為は賠償予定の禁止を定めた労基法16条違反になります。（「使用者は、労働契約の不履行について違約金を定め、又は損害賠償額の予定をする契約をしてはならない。」）
経営者の方から「欠勤をしたら罰金〇万円というルールにしたい」というご相談を受けることが時々あります。しかし、欠勤によって不就労となった時間の賃金カット以上の罰金をあらかじめ予定することは、上記の賠償予定の禁止に抵触します。さらに無断欠勤のような労働者に落ち度があるようなケースでなく、病欠のような場合にまで罰金を課すことは懲戒権の乱用とみなされる可能性が高いでしょう。
