ＨＩＳ、違法残業の疑い 東京労働局、書類送検へ
旅行会社大手のエイチ・アイ・エス（ＨＩＳ）が、東京都内の複数の店舗で従業員に労使協定の上限を超える残業をさせたとして、東京労働局は31日、労働基準法違反の疑いで法人としての同社と労務管理をしていた複数の幹部社員を近く書類送検する方針を固めた。
厚生労働省が2015年４月に東京と大阪の両労働局に設置した「過重労働撲滅特別対策班」（通称かとく）が昨年夏、同社に対して強制捜査に入った。押収した労務関係資料を分析するなどした結果、都内の複数の店舗で違法に残業をさせた疑いが強まったという。
関係者によると、同社は過去に違法な残業を従業員にさせたとして、複数回の是正勧告を受けているという。是正勧告を受けながらも改善がみられないことから、東京労働局は法人としての同社に加え、労務管理担当の複数の幹部社員も書類送検する方針を固めた。

電通や三菱電機など、過重労働で大手企業が書類送検という報道を目にする機会が多くなりました。これは、労働基準監督署の監督指導の比重が現場の安全管理からオフィスの長時間労働にシフトしていることを意味します。
昨年4月から全国の労基署による重点監督の対象が、「月100時間超の残業が疑われる全ての事業場」から「月80時間超の残業が疑われる全ての事業場」に拡大され、これにより、年間での監督対象数はこれまでの約1万事業場から約2万事業場へと倍増する見込みとなっています。
また、企業本社への監督指導、労働局の行う広域捜査活動を迅速かつ的確に実施できるよう、厚生労働省に「過重労働撲滅特別対策班」（本省かとく）が新設されました。さらに、全国47の労働局に「過重労働特別監督監理官」（かとく監理官）を1名ずつ配置し、長時間労働に関する監督指導等を専門に担当することとしています。
大企業を中心に、長時間労働対策は着々と進んでいます。これまでのように長時間労働に依存した体質から脱却できない企業には容赦なく労基のメスが入る時代になったと言えるでしょう。
