パナソニック工場で過労死 福井、下請け従業員
福井市のパナソニック森田工場に勤めていた男性が過労死と労災認定され、遺族代理人の海道宏実弁護士が９日、同市内で記者会見し、死亡する前の２カ月間、過労死ラインとされる月80時間ほどの時間外労働が続いていたと明らかにした。
男性はパナソニックの２次下請け会社「アイエヌジー」（福井県あわら市）の契約社員の上田浩志さん（当時46）。深夜勤務後の2015年10月、くも膜下出血により死亡した。福井労働基準監督署は長時間労働による過労が原因とし、今年１月31日付で労災認定した。
工場で上田さんは電子部品の加工を担当。午後11時から午前７時15分までの深夜勤務が固定化しており、15年３月から週の半分は２～４時間早く出社していたという。
パナソニックは「雇用関係がないのでコメントは差し控える」とし、アイエヌジーは「担当者がいないのでコメントできない」としている。

紙面上は小さな記事で詳細は不明ですが、過労死してしまった男性は、パナソニックの２次下請け会社の契約社員で、勤務場所はパナソニックの森田工場とのことですので、派遣か在籍出向のような形式を採っていたのでしょう。この男性の勤務時間帯は午後11時から午前７時15分までの深夜勤務。パナソニックのこの工場は24時間稼働で、日中はパナソニック社員が勤務し、深夜時間帯は下請企業の社員が勤務という勤務形態だったのでしょうか。
最近は長時間労働是正についての報道を連日目にするようになりましたが、そのほとんどは誰もが名前を聞いたことのある大企業で、中小企業の長時間労働対策がどこまで進んでいるかは興味のあるところでした。昨年6月に閣議決定された、ニッポン一億総活躍プランには以下のような文言があります。
関係省庁が連携して下請などの取引条件にも踏み込んで長時間労働を是正する仕組みを構築する。例えば、長時間労働の背景に下請法や独占禁止法（物流特殊指定）の違反が疑われる場合に、その取締りを通じて長時間労働を是正する仕組みを、厚生労働省、中小企業庁及び公正取引委員会で構築する。

つまり、雇用関係だけでなく、下請けや外注などの企業間取引も公正にしなければ、日本全体での長時間労働是正は達成できないことが明確に示されています。このご時世ですので、パナソニックでも時短はかなり進んでいるはずですが、そのしわ寄せが下請企業に行くのでは本末転倒です。それにしても、自社工場で働いていた方が過労死したにもかかわらず、「雇用関係がないのでコメントは差し控える」というパナソニックのコメント、リスク管理の観点からはやや危機感が足りないような気がしないでもないですが・・・。
