「てるみくらぶ」新卒内定者50人「先見えない」破産
破産手続きの開始が決まった旅行会社「てるみくらぶ」が、社員が80人程度しかいないにもかかわらず、50人もの内定者を出していたことが分かりました。
てるみくらぶの内定者：「だいたい50人ぐらいはきのうの説明会に来ていたので、（内定者は）50人ぐらいはいます」「（破産について）あと5日後には社会人になるんだという気持ちで準備を進めていたし、そういう思いでいたのでこれから先どうしたらいいのか先が見えない状態で、どうしたらいいのか分からない気持ちでいっぱいでした」
てるみくらぶは、来月1日に入社予定だった約50人の内定者を、27日に本社の近くに集めて説明会を開きました。山田社長が破産に至った経緯を説明し、全員の内定取り消しを通告しました。内定者のなかには、すでに地方から東京に引っ越してきて、家賃を払えない可能性がある人もいるということです。

珍しく日経新聞以外からの引用です。151億円もの負債を抱えて倒産、9万人にのぼる申込客の支払済み代金の大半が返金されない見込みなど、ここ数日世間を騒がせていたてるみくらぶですが、約50人の内定者が3月27日になって内定取り消し通知を受けた、というニュースです。
もちろん、楽しみにしていた旅行ができなくなった方や、渡航先でホテルをキャンセルされた方も大変お気の毒ですが、あと数日で入社予定の会社に、突然内定取り消しを告げられた学生の心中は察するに余りあります。
法律的に言うと、内定は「解約権留保付労働契約」を締結しているとされ、内定者の地位は、試用期間中の地位と基本的に同じものとみなされます。つまり、内定取り消しは解雇と同様に考えるべきであり、企業側の都合で一方的に内定を取り消すことはできません。とは言っても会社が破産してしまった以上、社員としての地位を求めることに実質意味はなく、内定者は他の就職先を探さざるを得ないことになります。
新規に設立された企業が10年以上存続する確率は1割にも満たないと言われますので、企業が倒産してしまうこと自体にはある程度やむを得ない面はありますが、倒産するにしても、顧客や取引先や社員にできるだけ迷惑を掛けないように配慮するのは経営者として最低限のマナーです。ところが、てるみくらぶは破産直前までツアー客募集の新聞広告を出し、さらに社員が80人程度しかいないにもかかわらず、約50人の学生に内定を出していたのです。
経営状況が良くないことは経営陣もかなり前から認識していたようですので、新卒採用を取りやめたり、もっと早い時期に内定取り消しを出せば、入社直前になって突然就職先がなくなるような事態は避けられたはずです。前途ある若者の希望を奪い取った経営陣の罪は重いと言わざるを得ません。
